By using Arcana, you agree to these Terms. Please read them carefully — they govern your relationship with us and set forth your rights and obligations.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Arcana ("we", "us", "our", or "Arcana") governing your access to and use of the Arcana mobile application, website, and all related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to change or modify these Terms at our sole discretion at any time. Any changes will be effective immediately upon posting the revised Terms. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of such changes.

2. Eligibility and Age Requirements

You must be at least 13 years of age to use the Service. If you are under 18, you may only use the Service with the involvement, supervision, and consent of a parent or legal guardian who agrees to be bound by these Terms.

The Service is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are under 13, do not use the Service or provide any information to us.

By using the Service, you represent and warrant that:

  • You are at least 13 years old (or the applicable age of majority in your jurisdiction).
  • If you are under 18, you have obtained parental or guardian consent.
  • You have the legal capacity to enter into a binding contract.
  • All information you provide is accurate, complete, and current.
  • You will maintain the accuracy of such information and promptly update it as necessary.

3. Entertainment and Disclaimer

IMPORTANT: Arcana is designed and intended for entertainment and personal reflection purposes. Some readings and interpretations are generated or assisted by artificial intelligence. Arcana is not intended to predict the future, provide medical advice, legal advice, financial advice, or professional counseling.

You expressly acknowledge and agree that:

  • Readings and interpretations are presented as entertainment and personal reflection tools only.
  • The Service does not predict the future, guarantee outcomes, or provide definitive answers to life decisions.
  • No reading, interpretation, or advice provided through the Service should be used as a substitute for professional medical, legal, financial, or psychological advice.
  • You are solely responsible for any decisions or actions you take based on information received through the Service.
  • Arcana shall not be held liable for any damages, losses, or consequences resulting from your reliance on any reading, interpretation, or advice.

4. Account Registration and Security

To access certain features of the Service, you may need to register for an account. When you create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your login method and for all activities that occur under your account.

You agree to:

  • Keep your login method secure.
  • Notify us immediately of any unauthorized access or security breach.
  • Not share your account credentials with any third party.
  • Not create multiple accounts for abusive or fraudulent purposes.
  • Not use another user's account without permission.

We reserve the right to suspend or terminate your account if we suspect unauthorized or fraudulent activity.

5. User Conduct and Content

You are solely responsible for all content you submit, post, or transmit through the Service, including dream descriptions, photos, messages, and friend data ("User Content"). You retain ownership of your User Content, but you grant us a limited license to use it as necessary to provide the Service.

5.1 Prohibited Conduct

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Infringe upon the rights of others, including intellectual property, privacy, and publicity rights.
  • Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, hateful, or racially or ethnically offensive.
  • Encourage or provide instructions for suicide, self-harm, or violence against others.
  • Engage in or promote child sexual exploitation or abuse.
  • Facilitate the use, sale, or distribution of illegal drugs or controlled substances.
  • Promote gambling, prostitution, or other illegal activities.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Transmit unsolicited commercial communications, spam, or pyramid schemes.
  • Upload or transmit viruses, malware, or other harmful code.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Collect or store personal data about other users without their consent.
  • Use the Service for any commercial purpose without our express written consent.

5.2 Content Moderation

We reserve the right, but have no obligation, to monitor, review, edit, remove, or disable access to any User Content at any time without notice for any reason. We are not responsible for User Content posted by users.

6. Subscriptions, Credits, and Payments

6.1 Free and Paid Features

Arcana offers both free and paid features. Free users receive a limited number of daily credits. Paid subscriptions, including Arcana+ and Premium where available, unlock higher daily reading limits and premium features.

6.2 Subscription Terms

  • Subscriptions are billed through Apple App Store or Google Play, depending on your device.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • You can manage or cancel your subscription through your device's account settings.
  • All payments are final and non-refundable, except where required by applicable law.
  • We reserve the right to change subscription prices at any time. Price changes will take effect at the start of the next billing cycle.

6.3 Credits

  • Daily credits reset every 24 hours and do not roll over.
  • Credit limits may differ by subscription tier.
  • Credits have no cash value and cannot be transferred, sold, or exchanged.
  • We reserve the right to modify credit limits, allocation rules, and pricing at any time.
  • If your account is terminated for violating these Terms, any unused credits or subscription time will be forfeited without refund.

6.4 Trial Periods

We may offer free trial periods for paid subscriptions. At the end of the trial, your subscription will automatically convert to a paid subscription unless cancelled. You may be required to provide payment information to start a trial.

7. Intellectual Property Rights

7.1 Arcana Content

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, software, algorithms, and the compilation thereof, are owned by Arcana or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

7.3 Restrictions

You agree not to:

  • Copy, modify, create derivative works from, reverse engineer, decompile, or disassemble any portion of the Service.
  • Remove any copyright, trademark, or other proprietary notices from the Service.
  • Use any automated system or software to extract data from the Service ("scraping").
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission.
  • Frame or mirror any part of the Service without our prior written consent.

7.4 Trademarks

The Arcana name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Arcana or its affiliates. You may not use such marks without our prior written permission.

8. Photo and Media Submissions

By submitting photos or media for palm reading, coffee cup reading, or face reading, you:

  • Represent that you own or have the necessary rights to the submitted media.
  • Grant us permission to transmit the media to our secure interpretation service for the sole purpose of generating your reading.
  • Acknowledge that photos are forwarded through Arcana's secure interpretation proxy for the requested reading and are not retained by Arcana after the reading is generated.
  • Agree not to submit any media that violates the rights of others or contains unlawful, harmful, or offensive content.
  • Understand that you should not submit photos containing sensitive personal information beyond what is necessary for the reading.

9. Friends and Social Features

The Service allows you to add friends and share insights. You agree that:

  • You will only add individuals who have consented to being added.
  • You are responsible for any interactions or relationships formed through the Service.
  • You will not use the Service to stalk, harass, or harm others.
  • We are not responsible for disputes or issues between users.
  • We may remove friends or disable social features at any time without notice.

10. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

11. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by Arcana. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

The Service integrates with third-party services including Supabase (authentication and database), Railway (secure AI request proxy), Sentry (error monitoring, once enabled), Apple App Store, and Google Play (payments). Your use of these services is governed by their respective terms and policies.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or, where account features are enabled, using the account deletion feature in the app. Upon termination, your right to use the Service will immediately cease.

12.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease.
  • All licenses and rights granted to you will terminate.
  • We may delete your User Content and account data, subject to our data retention obligations.
  • Any accrued subscription fees or credits will not be refunded.

12.3 Survival

Sections that by their nature should survive termination shall survive, including but not limited to Intellectual Property Rights, Disclaimer of Warranties, Limitation of Liability, and Governing Law.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

  • The Service will meet your requirements or expectations.
  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from using the Service will be accurate, reliable, or complete.
  • Any errors in the Service will be corrected.
  • The Service is free of viruses or other harmful components.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARCANA, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of, or inability to access or use, the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service, including readings and interpretations.
  • Unauthorized access, use, or alteration of your transmissions or content.
  • Any interactions, disputes, or harm arising between users.
  • Any errors, mistakes, or inaccuracies in the Service.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

15. Indemnification

You agree to defend, indemnify, and hold harmless Arcana and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Service.
  • Your violation of any provision of these Terms.
  • Your violation of any third-party right, including intellectual property, privacy, or publicity rights.
  • Your User Content or any content you submit, post, or transmit through the Service.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

16.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

16.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in class actions or class-wide arbitration.

16.4 Exception for Small Claims

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdiction of small claims court.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

18. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. No waiver of any provision shall be effective unless in writing and signed by the party against whom the waiver is sought to be enforced.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Arcana regarding the Service and supersede all prior agreements, understandings, and communications.
